The next step in booking with us is to give our contract below a good read through, let us know if you have any queries or concerns and we'll do our very best to accommodate. Then if you're happy, we will require a short booking form to be filled in below, along with a 20% deposit of €50 to be paid through bank transfer.

Once we’ve received the form and payment, we’ll confirm with you safe receipt and send you a link to a copy of the contract where you can digitally sign and download for your reference - your photo session will then be secure in our calendar!!

Around one week before your photo session is due, we’ll email you a more detailed form to fill in online along with payment details for the remaining sum of €200 to be paid no later than two days before your session date. We can then arrange a call/videocall to chat over things if required.

Terms of agreement (T&Cs)

Please read the following contract and ensure that you have understood all the conditions.

​These terms and conditions explain your rights and responsibilities and also ours. 

“You” means the Client named in the Contract, “We” means Mellows Photography. 

The “Contract” means the contract accepted by you in submitting the Booking Form, and incorporates these terms and conditions.

1. We agree to supply to you photography services in accordance with the Contract. The Contract incorporates all the terms agreed between us.

2. The Deposit is payable by you on submitting the Contract/Booking Form. This will be set against the total fees payable by you and is non-refundable.

3. The Balance of the Package Fee must be paid by you no less than 2 days prior to the date of the photo session. If the Package Fee is not paid by that date, we reserve the right not to provide any services until payment is made or to treat the Contract as being cancelled by you. The provisions of clause 13 will then apply.

4. We will discuss with you your general requirements and wishes in relation to the taking of the photographs. You should be aware that it may not be possible for these to be followed due to factors such as weather conditions, lighting conditions, the subjects being photographed and time constraints. You, therefore, grant us full and unfettered artistic licence in relation to the content of the photographs, their arrangement, composition, location and the number of photographs taken.

5. Photographs will be taken against the available backgrounds. Please note that moving objects or performing other cosmetic duties on location is not part of our service.

6. Every effort will be made to provide a good colour balance between photographs but this may not always be possible due to factors such as lighting conditions and digital sensor limitations. Prints made from different companies or in different sizes may also vary. Accordingly, no warranty is given that an exact colour match can be provided.

7. The time frame for delivery of digital images from your session date will be up to 6 weeks.
8. We keep your digital media for at least 24 months. You are advised to make a back-up of the digital photographs you receive from us to protect yourselves in the event of loss, digital corruption or theft etc.

9. Upon receiving your photographs, you also receive Usage Rights to accompany them. Specifically, you receive a Personal licence to use your images for Personal Use - for example printing for personal display, using them on your social media, giving copies to friends and family for their personal use and display, and creating your own personal products (prints, calendars, photo books, albums). There is no time or geographic limit on this Personal licence. Your licence precludes Commercial use. Examples of commercial usage include but are not limited to; uploading to a stock image library, syndicating (re-selling), publishing in print and online media or promoting a commercial enterprise. The copyright in all images and copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer file or printed documentation relating to such images remains our property, but you have a licence to use them for Personal, non-commercial use. If, at any stage, you are unsure as to whether a use you are putting your images to is considered commercial, you agree to contact us to check your rights.

10. We reserve the right to use or display images agreed to as part of our portfolio, at exhibitions, or for marketing purposes eg. social media etc but will not use any photos that you request to be kept private.

11. In the unlikely event that we are unable to perform the Contract for reasons beyond our control (for example, death injury, illness), we will make every effort to reschedule to the earliest possible date, if this isn’t possible the Contract shall be cancelled and our liability to you shall be limited to a full refund of all fees paid by you.

12. We will take the utmost care with respect to the exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond our control, our liability is limited to the refund of all payments received, or a reshoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged.

13. You may cancel the Contract at any time by notice in writing. You understand that by entering into this agreement, we are foregoing other photographic jobs. In the event of a cancellation of the photo session, the amounts paid are non-refundable. In the event of a postponement, the fees paid by you can be transferable to a new date agreed to by both parties. Twenty-four hours notice of postponement or cancellation is appreciated.

14. If it is not possible for a session to take place on a scheduled day due to weather, we will reschedule on an agreed date at the earliest date possible, with no additional charge.

15. The photo session you are booking with us for up to one hour coverage is priced at €250 and includes all travel expenses, 2 photographers, 80+ fully edited high resolution images in a range of colour and black & white, a password protected online gallery and all liability and indemnity insurances, VAT and license to print rights.
